10 Year Mattress Warranty

The EzoBed Limited Mattress Warranty covers solely the original purchaser of a mattress who remains in possession of the purchased product at the time of a warranty claim. This limited warranty extends for a 10-year period from the date of purchase of a new mattress and applies to defects in materials and workmanship for EzoBed mattresses.

The terms of the limited mattress warranty are as follows: (i) the warranty is not transferable and can only be claimed by the original purchaser of a mattress who remains in possession of purchased mattress at the time of a warranty claim; (ii) the customer must have purchased the mattress from EzoBed, Inc.; (ii) the mattress must be registered with EzoBed, Inc.; (iii) the defects stated by the customer must concern materials or workmanship of the product purchased; (iv) the defects must not have resulted from normal wear and tear and proper handling or from use of the mattress outside its intended purpose or; for example: (a) a visible indentation or sag greater than one (1) inch in the foam material, meaning an indentation that is visible when no weight is applied to the top of the Product.; (b) any physical flaw in the foam material that causes it to split or crack; or (c) any manufacturing defect in the mattress cover such as fabric tearing or stitching unraveling; (v) all mattresses must be opened, installed, and cleaned in accordance with the use and care instructions included with the mattress upon delivery; (vi) any repair or replacement will not extend the original period of limited warranty, nor will it constitute the start of a new limited warranty period; and (vii) the customer must notify EzoBed Customer Service of any warranty claim by email at hello@ezobed.com and provide all of the information required under these terms and conditions.

If the terms of the EzoBed mattress limited warranty legitimately apply, EzoBed will take responsibility for the repair or replacement of the mattress or its material components (e.g., the mattress cover). EzoBed holds full and complete discretion to decide between repairing and replacing a mattress. In the case of a manufacturing defect in the mattress cover, EzoBed may decide to repair or replace the mattress cover rather than replace the entire mattress and holds full and complete discretion over that decision. In the event EzoBed decides to replace the mattress cover, it will do so by replacing it with the current style and make of cover available, which may be an alternate color or of different material than the original, defective cover.

If EzoBed concludes that an EzoBed mattress limited warranty applies and decides to replace a mattress, the replacement mattress will be provided only with the customer’s compliance with the following terms: If the warranty claim is made within the first two (2) years of the mattress delivery date, EzoBed will replace the mattress with no charge to the customer for the mattress. If the warranty claim is made any time after two (2) years up to and including five (5) years from the date of delivery of the mattress, the prorated replacement charge to the customer is 30% of the original purchase price of the mattress. If the warranty claim is made any time after five (5) years up to and including eight (8) years from the date of delivery of the mattress, the prorated replacement charge to the customer is 50% of the original purchase price of the mattress. If the warranty claim is made any time after eight (8) years up to and including ten (10) years from the date of delivery of the mattress, the prorated replacement charge to the customer is 75% of the purchase price of the mattress. 

When the replacement of a product is in compliance with the terms of this warranty, a customer may upgrade to a more expensive product by paying the difference between the pro-rated cost of the original product being replaced and the pro-rated cost of the upgraded product, plus the cost of any related additional sleep system pieces included not being replaced as part of the upgraded warranty exchange. 

The customer will be responsible for any shipping or other expenses incurred for return of a product and delivery of a replacement. Defective mattresses, product invoice, prepaid to EzoBed and any other products received as part of the mattress purchase and included in the mattress purchase price, must be returned, at the address below.

Warranty Exclusions

This warranty does not apply to changes to the mattress caused by, or as the result of, normal wear and tear, nor changes caused by, or as the result of, circumstances or uses that are outside the intended reclining and sleeping use of a mattress.

Every EzoBed mattress is crafted individually. Some degree of variation in the completed product is a natural part of this kind of product production and is to be expected. Imperfections that do not hinder or affect regular use and comfort of the product are not considered to be defects. For example, surfaces may not be perfectly flat, and corners may not be perfectly shaped or symmetrical. These conditions and any other similar conditions are not considered to be defects for which customers can seek any recourse under the warranties described within this document.

EzoBed mattresses are designed to work on a firm and stable bed-base surface, (e.g., a frame or platform) that is structurally capable of supporting the weight of the mattress and a user on top of it. This warranty does not cover the product if it has been used in a fashion incompatible with the designated use for which it was designed. EzoBed mattresses are intended to be used on a foundation with a center support that has at least 5 to 6 support legs for a queen or king, or with 4 support legs for twin, twin XL, and full mattresses. For queen or king slatted-style bed frames, it is incumbent upon the customer to ensure the frame utilized offers adequate structural support for the mattress and foundation for the particular slatted-style frame being used.

This warranty specifically excludes: (a) minor imperfections and cosmetic flaws; (b) normal wear and tear; (c) tears, stains, soiling, burns, and discoloration that occur over time; (d) dampness or mold; (e) individual or personalized preferences relating to firmness, texture, comfort, etc.; (f) normal body impressions not greater than 1” in the mattress as measured below the quilt level. The settling of quilt fibers is to be expected and is not considered a defect; (g) individual or personalized allergies and sensitivities; (h) naturally occurring cotton or foam aromas; (i) a normal increase in softness of the foam and foam pressure-relieving material which does not affect the pressure-relieving qualities of the mattress.

In addition, this warranty does not cover conditions resulting from abusive handling, misuse, or neglect. Therefore, if these circumstances are discovered during inspection, it will render the warranty void: (a) any unsanitary condition; (b) burns; (c) use of the mattress on an improper or non-suitable bed frame; (d) physical abuse to the product; (e) any attempt to clean the product in an inappropriate manner; and (f) improper storage of the product, including but not limited to: storage in a damp location(s), the presence or evidence of insects or rodents, or damage from any other unprotected storage area(s); (g) purchase from resellers who are not authorized retailers.

Customer Rights

This warranty provides for specific legal rights, and these rights may vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages in connection with the sale of consumer products, so the above limitation or exclusion of incidental or consequential damages may not apply. Customers may also have additional rights that are not included in this document. 

Refund Policy

If a refund is provided to a customer in accordance with these terms and conditions, the refund will only be credited to the credit card or debit card used as the original method of payment for the original order transaction.

Other Terms and Conditions

Any questions or concerns pertaining to medical or health conditions should be addressed by a licensed physician. EzoBed makes no medical or health claims regarding its mattresses. Allergies, discomfort, or other conditions, are not covered under this warranty.

Written Notices and Claims

To make a claim under any warranty provided under these terms and conditions, send an email to EzoBed at hello@ezobed.com with the following: (i) a brief written description and, if possible, a photo of the alleged defect or problem; (ii) proof of purchase (order number or an original dated sales receipt); and (iii) proof that the law labels are in place on the product (photo if possible).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR RESELLERS, DISTRIBUTORS, AND/OR SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, BEYOND THOSE SET FORTH IN THESE TERMS AND CONDITIONS AND IN OUR MARKETING MATERIALS. EACH OF THOSE PARTIES DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY AND IMPLIED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE FACE OF THIS CONTRACT.

IN NO EVENT WILL WE OR OUR RESELLERS, DISTRIBUTORS, AND/OR SUPPLIERS BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM YOUR PURCHASE AND USE OF THE PRODUCT, EVEN IF WE OR SUCH OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) NEGLIGENCE, OR (4) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
